1. You acknowledge that Have14.Us/tridive.com is a service supported by members and sponsors. Should you become an advertising publisher, the supplied HTML code at your web site will display banner advertisements other that your own. They include members who have purchased credits from Have14.Us/tridive.com. Other paid sponsors may advertise at the web site itself or through the banner network at the discretion of Have14.Us/tridive.com

2. Members agree that at any point in time a Have14.Us/tridive.com banner, another advertisers banner, or a sponsors banner will show on their site in the course of banner rotations. Members understand for banners displayed below the top fold of the screen, that they may earn credits if they are given publishing rights. Advertisers must supply their own 468X60 banner. Publishers agree to email Have14.Us/tridive.com should they remove or change the position of their advertising coding after so their credits can be adjusted accordingly.

3. Publishers must place their banner coding on a page where the majority of visitors would see it. A banner must not be hidden. On pages with frames, the same applies.

4. Visitors to publishers sites must be allowed to back out of the site, rather than being pushed forward or blocked from backing out. Any members attempting to alter Have14.Us/tridive.com html code without written permission are subject to removal. Publishers are allowed to use Have14.Us/tridive.com banners on as many pages of their site that they wish. Have14.Us/tridive.com reserves the right to revoke any credits, impressions, or value at anytime based upon Have14.Us/tridive.com's sole discretion. In addition, it is a crime to steal bandwidth. Publishers and Advertisers understand that Have14.Us/tridive.com monitors impressions from IP address. Reports are generated from IP address that have numerous page loads from the same IP address over a given period of time.

5. You may not artificially inflate traffic to your site through devices, programs, collaboration with other members, or by other means. You may not create multiple Banner Delivery accounts for the same web pages unless you obtain prior written consent from Have14.Us/tridive.com.

6. You must insert the HTML codes into your web pages as instructed. You may not include the Have14.Us/tridive.com HTML code on any page that automatically reloads or redirects the user to another page without user interaction.

7. The following types of sites are NOT allowed on Have14.Us/tridive.com network as either publisher or advertiser; sites containing or promoting pornography (in text or graphics); sites encouraging illegal activity and racism; sites providing instructions or permitting dialogs about conducting illegal activities; sites that promote unsolicited e-mail; sites that are otherwise inappropriate as determined by Have14.Us/tridive.com

8. No "get rich quick" sites. This would include a site solely consisting of affiliate member links.

9. No Have14.Us/tridive.com code is not to be put in pop up windows without Have14.Us/tridive.com's express written consent..

10. Advertisers and Publishers agree to accept email notices about their sites subject(s) from Have14.Us/tridive.com or its advertisers. These email notices will never be more than once per week. Have14.Us/tridive.com agrees to never sell your email address to address brokers.

11. Have14.Us/tridive.com guarantees that if you follow the marketing plan and estimated payback schedule you will realize a 1 to 1 return on investment. The return is based upon referral income. generated from a minimum of 18 referral meetings and a 33% rate of acceptance.  A 3 to 1 Return on investment is expected from the sales generated from the purchased ad campaign, but effects such as sales price of the client product, economic conditions, and buying habits may effect outcomes for which Have14.Us/tridive.com cannot be responsible. If the client has arranged and attended the meetings with little or no results, and has not achieved an increase in sales equal to the amount spent on the purchase of the program (excluding monthly payments), a prorated refund of the initial purchase price of the program will be calculated and credited to the client.

12. Have14.Us/tridive.com reserves all rights to the Have14.Us name, logo, banners, web site, reports, databases, and software. All materials associated with Have14.Us/tridive.com are protected by copyrights which are owned and controlled by Have14.Us/tridive.com and may not be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way without prior written consent from Have14.Us/tridive.com. Modification of the materials or use of the materials for any other purpose is a violation of the copyrights and other proprietary rights.

13. You acknowledge and agree that your web site information may be published in association with the Have14.Us/tridive.com web site, i.e. in the member's directory, on top ten lists, in tutorials, articles, or any promotional materials.

14. Have14.Us/tridive.com services are provided "as is" and without warranties of any kind either express or implied. To the fullest extent permissible pursuant to applicable law, Have14.Us/tridive.com disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. Have14.Us/tridive.com does not warrant that the functions contained in the materials will be uninterrupted or error-free, or that defects will be corrected. You (and not Have14.Us/tridive.com) assume the entire cost of all necessary servicing, repair or correction. Applicable law may not allow the exclusion of implied warranties, so the above exclusion may not apply to you.

15. When you purchase from Have14.us/tridive.com you are purchasing a service.  A creative service key driver is time and as such, all payments made to have14.us/tridive.com are non-refundable, or may be refundable or partially refundable at the sole discretion of the service provider

15. You agree to indemnify Have14.Us/tridive.com and its staff, officers, employees, agents, distributors, and affiliates from or against any and all third party claims, demands, liabilities, costs, or expenses, including reasonable attorney's fees, resulting from your breach of any of the foregoing agreements, representations, and warranties.

16. Have14.Us/tridive.com reserves the right to verify your compliance with this TERMS OF USE through any means necessary. If you are determined by Have14.Us/tridive.com to have violated this Terms of Use, then your account is subject to immediate and permanent termination without any obligation by Have14.Us/tridive.com to redeem any earned or paid credits.
